WHO TO CALL IF I AM BEING ARRESTED?

Section 10(a) of the Charter: Right to Be Informed of Reasons for Arrest or Detention


  • You must be promptly informed of the reason for your arrest or detention.

  • This right ensures that you know the specific legal grounds for your arrest or detention.

  • The information must be clear and understandable at the time of arrest or detention.

Section 10(b) of the Charter: Right to Counsel and to a criminal lawyer


  • You have the right to contact a lawyer immediately upon arrest or detention.

  • The police must inform you of your right to legal counsel.

  • The police must provide you with access to a telephone to contact a lawyer.

  • You have the right to consult with a lawyer of your choice, but if they are unavailable within a reasonable time, you may consult with duty counsel (a lawyer provided through legal aid).

  • No evidence can be gathered until you’ve had a reasonable opportunity to contact a lawyer.

  • The police cannot obstruct or delay your attempt to exercise your right to counsel.
